摘　　要：深圳市地铁集团有限公司采用FIDIC条款作为施工承包的合同条件,与承包方在工程实施过程中博弈,并取得良好的谈判结局。此文以该项目为案例,就地铁工程施工出现合同纠纷时,如何理解和引用FIDIC《施工合同条件》有关条款妥善处置分歧进行探讨,并在总结其经验和教训的基础上,提出了若干FIDIC条款引用时的注意事项。Shenzhen Subway Corporation introducing FIDIC as conditions of construction contract, gamble with outsource vendor in the process of the construction and gained a good ending at last. Taking this project as an example, this paper discussed how to comprehend and refer FIDIC relevant items to settle conflicts. Having summarizes its experiences and lessons, this paper also puts forward some points for attention in the process of introducing FIDIC.
