摘 要:随着中国改革开放的深化和市场经济的蓬勃发展,土地越来越成为一种稀缺资源。由此带来的围绕土地这种要素产生的权益和权利之争引发一系列社会问题,本文以房屋拆迁制度为考察对象,在对博弈参与人政府、拆迁人和被拆迁人的权益和权力进行分析之后,阐明了相互之间存在的利益冲突,提出中国现行房屋拆迁立法的应然价值取向,找到管理的优化途径,最有效率地配置法律权利、义务和责任资源。With the deepening of opening-up policy and rapid development of market economy, land increasingly acts as searce resources. Consequently, the conflicts of interest and powers brought by land has triggered a series of social issues. This article is objected at China's household removal system, illustrating the interest conflict between each other after the analysis of the interests and powers between the participants of government, developer and household to be resettled, then proposing the should however value orientation of our current housing legislation, finding out the optimal path to manage and allocate the legal rights, obligations and responsible resources most efficiently.
