摘　　要：专利制度的核心是专利法。从制度变迁的视角研究了我国专利法的制定及其3次修订过程。在这个过程中,政府或主动、或被动进行的"制度模仿",促进了我国专利制度的建立和发展。但随着我国政治经济的发展,我国专利制度变迁的内生性特征日趋明显和重要,这表明我国专利制度的有效性正日趋增强。Patent law is the core of patent institution. This paper checks the reasons of Chinese patent law legislated and amended in view of the economic theory of institutional change. During this process, the institutional imitation accepted by the government voluntarily or passively, prompts the establishment and development of China＇s patent institution. Meanwhile with the economic development, the patent institutional changes are mainly endogenous and more efficient.
