大型体育赛事法律规制的理论与实践研究——以厦门国际马拉松赛为例

摘　　要：厦门马拉松赛作为城市政府提供一项公共产品、公共服务,为适应市场化、社会化、法制化发展,建立与完善相关的法律规制是必要的、也是可行的。研究从理论和操作两个层面上展开了该赛事政府的主体地位、法律责任和供给模式的讨论,提出立法、执法、守法三个议题;探讨了厦门马拉松法律规制的选择及其法律规制的一般理论及其意义;涉及赛事管理中组织形态、"权"与"利",以及侵权、风险规避等几个法律规制问题。在此基础上,提出赛事体制改革、建立法律规制、完善司法体系三方面对策与建议。Xiamen marathon,as a public product and service provided by city government,is necessary and available to establish and complete the legal regulation related in order to adapt to the development of market-orientation,socialization and legalization.This paper studies the government’s principal status,legal liability and supplying model about the match on theory and operation’s level,and propose three issues which are legislation,law-enforcement and law-abiding.To explore the selection on legal regulation of Xiamen marathon and the general theory and significance of the legal regulation; the research covers the organization,rights and profits in the match,as well as certain legal regulation problems as infringement and risk-aversion.On the basis of above studies,the research proposes advices on the following three issues as match system-reformation,establishment of legal regulation and improvement of judicial system.
