摘　　要：土地上房屋征收问题由来已久,最近更是占据了民众视线的焦点。理性地设计我国的房屋征收制度,是建立私人财产保护制度进程中必须完成的一项历史性课题。对于房屋征收问题,必须从三方面给予高度关注:城市规划中公民参与不可忽略;公共利益认定的关键是要设立一套合理、公正、科学的认定程序;房屋的补偿标准应遵循市场原则并合理考虑相关因素。The problem of housing levy and compensation has lasted for long,and focused on the center of public attention more recently.Rational design of the common collection system in China is a historic task,in which the establishment of private property protection system in the process must be completed.Regarding the housing levy issue,Citizen Participation in urban planning can not be ignored;the public interest identified by the key is to set up a reasonable,fair and scientific identification process.On the Legislation design,throughout the housing levy and compensation,it is necessary to introduce the links of the legislature,the judiciary and the counterpart to the supervision of the executive power and checks and balances.
