公共危机:警察如何应对——以警察权为视角

摘　　要：公共危机是现代世界各国面临的重大而紧迫的问题。目前,我国正处在"人为性公共危机"的高发时期。由于现行法律法规对警察公共危机处置权规定的分散性和模糊性,不利于警察把握危机化解的最佳战机和处置权适用尺度,若使用不当,甚至可能还会加剧危机的发生程度。因此,应当对警察法重新进行修订,增设并合理地配置警察公共危机特别处置权,强化警察在公共危机事件中的行政调解职能,为警察依法、有效地处置公共危机事件提供支撑。Public crisis is a major and urgent issue faced by the modem world. At present, ＂manmade public crisis＂ is spreading in China. Due to the dispersity and the ambiguity of current laws and regulations on the right of the police disposing of public crisis, it is not conducive for the police to seize the best opportunity to defuse the crisis and use their disposal right properly. On the contrary, if used improperly, it may aggravate the degree of the crisis. Therefore, the Police Act should be re-amended, adding and reasonably allocating special right of the police disposing of public crisis as well as strengthening the administrative mediation function of the police in handling public crisis so as to provide foundation for the police to legally and effectively dispose of public crisis.
