摘 要:在实践中,对“特殊情形”与农村承包地调整的逻辑关系的认识存在着片面化、否定、不恰当扩大适用对象等问题。在我国农村承包地调整制度中客观存在着法定双向调整、法定单向调整、约定双向调整等承包地调整模式。从分析中可见,在农村承包地调整中并非只有在“特殊情形”下才可能适用农村承包地调整,因而“特殊情形”与不同模式的承包地调整之间存着不同的逻辑关系:“特殊情形”是法定双向调整的必要条件;“特殊情形”是法定单向调整的充分条件;“特殊情形”是约定双向调整的选择性条件。In practice, there exist problems of being one-sided, negative, inappropriate to extend suitable objects in understanding the logic relation beween "special case" and adjustment of rural contracted land. At present, there are different contracted land adjustment models as statutory two-way adjustment, statutory one-way adjustment and agreed two-way adjustment in Chinese rural contracted land adjustment system. The following analysis shows that the rural contracted land adjustment is applied not only in special cases, therefore, there exists logic relation between special case and contracted land adjustment of different modes: to be specific," special case" is a necessary condition for statutory two-way adjustment, a sufficient condition for statutory one-way adjustment and selective condition for agreed two-way adjustment.
