摘　　要：情谊活动中的侵权行为在生活中较为常见。为保护受害人的合法权益,应当赋予受害人以侵权损害赔偿请求权。情谊活动中的行为人采取了合理措施预防危险、制止危险或进行事后救助就可以认定为尽了必要的安全注意义务。同时,情谊侵权责任的归责原则只能适用于过错责任原则。A tort in friendship activities is very common in life. In order to protect the lawful rights and interests of the victims, it is necessary to give them the claim right of tort. Due to the lack of laws and regulations, we should correctly define the theory and basis of claim right, and the principle of accountability.
