摘　　要：随着经济社会的发展,近年来我国离婚率不断攀升,夫妻在离婚后共同债务如何认定、怎样区分等问题成为司法实践中的一个重要问题。尤其是共同债务认定后,在司法实践的执行中却往往存在较大的困难。法律应该如何在尊重双方当事人意思自治的前提下,注意保护善意第三人的合法权益,是文章所欲达到的主旨。With the development of social economy in China,the rate of divorce is soaring.How to identify the common debt of marriage has become an important issue.Especially,after the identification of common debt,there is still great difficulty in judicial practice.The respect of autonomy of activity to the parties in marriage,and the protection of third party with goodwill,are the contents in this article.
