摘　　要：企业在实施合作创新战略时,经常面临"合作创新困境",主要原因是合作创新与知识产权之间存在冲突。因此,有必要对合作创新中的知识产权问题展开深入系统研究。首先根据权利取得的形式,将知识产权分为显性和隐性知识产权两大类,分析了两者在专有性、时间性、外部性等方面的区别。其次,根据权利的占有形式,将合作创新中的知识产权分为独享型和共享型知识产权两种,分析了两者间的关系,提出双三角理论。进一步,针对合作创新中的知识产权问题进行分析。最后,针对相关知识产权问题进行了讨论,给出有价值建议。While implementing the strategies of cooperative innovation, companies often face with innovation dilemma because of the conflict between cooperative innovation and intellectual property. The paper studys the problems of intellectual property. Firstly, intellectual property is divided into explicit intellectual property and tacit intellectual property according to the form of right obtained. And its differences are analyzed. Secondly, intellectual property in cooperative innovation are divided into monopoly intellectual property and sharing intellectual property according to the form of right owned. Their relationship are studied and the double-triangle theory is proposed. Finally, the paper discusses the related problems of intellectual property and gives the valuable suggestions.
