论我国著作权强制许可制度之构建

摘　　要：著作权强制许可制度是一项国际上普遍认可的著作权限制制度,其在平衡著作权人利益和公共利益需要,以及促进著作权贸易方面具有自己独特的功能和作用。我国至今尚未建立著作权强制许可制度,仅依靠合理使用和法定许可制度平衡著作权人利益和公众接触和利用受著作权保护作品的需要,其不足之处已日益显现。因此,我国应尽快构建一套包括强制许可适用条件、范围、申请审查程序和补偿标准等内容,并且宽严得当的著作权强制许可制度。Compulsory License System on Copyright,as an internationally recognized system of restriction to copyright,maintains its own unique function and effects in promoting the copyright trade and keeping a balance between copyright owners＇ interests and public interests.However,China has not established a compulsory license system on copyright till now.What we are doing is just to adopt our Fair Use System and Statutory License System to balance the copyright owners＇ rights,have effective communication with the public and make use of the demands for the works protected by copyright.The disadvantage of this method has increasingly become obvious.Therefore,it is highly necessary that we establish as soon as possible a set of compulsory license systems on copyright,including the conditions and scope of compulsory license,the procedure of retrial application and the criteria of compensation.
