摘　　要：我国高校专利成果转化率较低和产业化水平不高的状况,很大程度上缘于我国高校专利成果转化立法建设的不完善。立法不足对高校专利成果转化造成了很大的制约。我国亟需通过对西方先进国家高校专利成果转化立法的研究和借鉴,加快我国高校专利成果转化方面的立法建设,为高校专利成果转化提供一个良好的法律环境。In China,both the transformation rate of the college patent technology achievements and the level of industrialization are still low.There is deficiency in legislation of transforming college patent technology achievements.We are badly in need of learning and using the experience of western developed countries to accelerate legislative construction of transforming College patent technology achievements.In this paper,through the introduction of theory related to college patent technology achievements and general analysis of legislation situation of transforming,college patent technology achievements both home and abroad,and,based on absorbing the advanced experience in western countries,some advice has been given on the improvement of the legislation of college patent technology achievements transformation.Hopefully,this paper could have a positive impact on the legislative construction of transforming College patent technology achievements.
