摘　　要：BOT投资方式是一种高风险的投资、贷款活动,其围绕项目投融资、建设、运营、移交构成一项复杂的系统工程。尽管近年来我国颁布了一些法律法规来消除其带来的消极影响,在保证BOT正确发展的同时,确立了对其全方位的保护措施。但应看到,相对BOT发展状况而言,我国此方面的立法仍相对滞后,有待于通过进一步的立法来健全管制与保护制度。BOT is a high-risk investment and money-borrowing activity;all these feaures above mentioned make it stand out the conventional investment means.The financing,building operating and transferring form a complex systematic project.In recent years,our country issued some laws and acts to eliminate the negative effect it brought,which not only maintained its development in the right direction,but also established an all-around protective measures.But what we should see that,in contrast to the development of BOT.Our country＇s legistration has yet to perfect the control and protection system.
