摘　　要：赵作海错案形成的原因错综复杂,但归根结底还是我国刑事诉讼制度存在的缺陷所致。文中结合赵作海错案的形成过程,从我国刑事诉讼制度缺陷及完善的角度进行理性思考。在对赵作海冤案进行多方位深层次分析的基础上,提出了一些杜绝冤案发生的对策。Zhao Zhouhai misjudged case had the complex cause,but in the final analysis it was resulted from the defects of our crimi-nal procedural system.Combining the formation of misjudged case,this paper carried on the rational thinking on how to perfect the defects of criminal procedural system.By the in-depth analysis the paper proposed some countermeasures to prevent the misjudged case happen.
