摘　　要："和谐"就是以公开的形式,通过妥协的方式,达到一致的结果。"社会"语词只不过是"群体"的代名词而已,而社会概念则是指和谐的人际关系。人是与动物相对的概念,社会是与自然相对的概念,规范是与本能相对的概念,人的本质属性是社会性,社会的本质属性是规范性。规范的产生标志着社会的形成,社会的形成标志着人的产生,因此,人、社会和法三位一体,构成和谐状态。不和谐的社会是靠恶法来维持的。真正的和本质上的法是民主意志的体现,而恶法则是被奉为法的统治阶级的意志,它不仅不是法,而且是对法的践踏。构建和谐社会,让法回归到民主意志上来,是顺应时代的要求。Harmony is an agreement which is reached openly and by means of compromise. The word of society is only a pronoun of colony, but the concept of society implies harmonious human relationship, Human being is opposite to animal, society to nature and norm to instinct. Human natural attribute is sociality and social natural attribute normativeness. The occurrence of norms marked the start of human society and the coming into being of human society indicated human existence. For this reason, human being, human society and human law comprise harmony. Inharmonious society is maintained by immoral law. Real and essential law is a reflection of the people＇s will. But immoral law is the will of the ruling class which is so-called law. It is not law and moreover it tramples law. To build a harmonious society and let the law reflect the people＇s will just meet the demand of the time.
