摘 要:经济自由是指经济活动的主体可以依照自己的意愿进行经济活动,并承担相应的后果。经济自由本质上是为了保护市场主体的个人权利,是自由权的重要内容。政府基于公共利益的维护对非公有经济在公用事业的市场准入方面实行管制,实质上是对经济自由的限制。我国宪法虽承认了非公有经济的合法地位,但对于非公有经济的经济自由权却未明确规定。宪法的功能不仅在于对国家政治权力的限制,还应对国家干预经济的经济权力的限制。在公用事业市场准入问题上,有必要将经济自由提高到宪法层面加以保护,平等对待非公有经济主体。Economic freedom means that economic subjects are able to engage in economic activities according to its own will, and take the corresponding liabilities. In essence, economic freedom is to protect market subject's individual rights. It is the important content of freedom rights. Government regulates on the non-national economy's market access in public utiIities, to protect public in- terests, which is essentially a restriction on the economic freedom. It is admitted that non-natlonal economic status is lawful in China's constitution, but non-national economic freedom has not definitely been defined. The function of constitution is not only to restrict government's political power, but also to make restrictions on government's intervention on economic power. For public utilities' market access, t is necessary to protect economic freedom by means of constitution, and treat non-national economy equally.
