摘　　要：随着我国国际经贸活动的日益频繁,涉外商事代理业务的重要性日渐彰显。然而,我国涉外商事代理的现行法律规定存在笼统和混乱问题,尤其是在法律适用方面,表现出来的障碍比较突出。为此,需要对涉外商事代理制度进行科学的创新和完善,以及充分借鉴海牙《代理法律适用公约》进行调整和修正,有效解决我国涉外商事代理制度的法律适用障碍问题,促进我国涉外商事代理事业的快速发展。With the increasing in international trade,foreign-related commercial agency has gained ever-increasing importance.However,problems caused by abstractness and confusion do exist,especially prominent in the law application to foreign-related commercial agency.Therefore,we need to reform the old systems and regulations,borrow from Hague International Convention of Legal Application of Agency,thus overcome the obstacles and develop the business of foreign-related commercial agency.
