知识产权争端与美中双边产业内贸易:经验研究  

Intellectual Property Rights Disputes and U.S.-China Bilateral Intra-industry Trade:An Empirical Analysis

摘　　要：运用GL指数和二元选择模型研究发现:(1)1995—2006年美国对中国发起的知识产权争端排除令涉案产品中23起产业内贸易指数都比较小,且20起涉案产品美方处于贸易逆差失衡。(2)美国对中国发起知识产权争端的概率将随该产品美中产业内贸易程度下降而增加,这证实了美中知识产权争端不是源于这些涉案产品的产业内贸易竞争效应而是源于产业内贸易失衡效应。(3)美国对中国产品发起知识产权争端的概率将随美中知识产权协议效应上升而减少。但是,美中涉案产品的贸易差额变量在统计上不显著。对策是,中国应通过技术引进和产业升级逐步提高美中双边产业内贸易程度;作为知识产权弱势的贸易大国,中国应在美中知识产权争端中力争利用双边协议效应;中国走出贸易中知识产权劣势格局的路径是转变外贸增长方式,坚持自主创新的发展模式,提升竞争优势。This paper uses GL index and Binary Choice Model,and gets some valuable findings.In detail,（1） twenty-seven goods were involved into the exclusion order of U.S.intellectual property rights（IPR） disputes against China,and twenty-three goods of them had rather small intra-industry trade（IIT） indices during 1995—2006;moreover,the U.S.suffered trade deficit imbalance from twenty goods of them.（2） The probability of U.S.IPR disputes against China increased along with the decrease of IIT index of these goods.Thus,U.S.IPR disputes against China were not caused by the ITT competition effect of these goods but caused by the IIT imbalance effect.（3） The probability of U.S.IPR disputes against China decreased along with the increase of the effect of intellectual property agreement.However,it is proved that U.S.-China trade balance of these involved goods is not significant statistically.The proposals are that China should enhance gradually the degree of U.S.-China bilateral IIT through technology import and industry upgrade,and that China should utilize actively bilateral agreement effect facing U.S.IPR disputes against China.The optimal approaches,which can lead China out of the disadvantage of IPR protection,are that China changes the mode of foreign trade growth,adheres to the developing mode of self-innovation and promotes the competitive advantage.
