公证机构转制中的困境与出路

摘　　要：针对四川省独立法人地位公证处运行实践中存在的问题:有的行政色彩浓厚主管部门不肯放手、管得过死,有的又监管困难甚至失控,公证处商业化倾向严重、忽视公证质量,存在滥用国家法律证明权现象,搞分光吃光,后续发展乏力,独立法人地位好像并没发挥制度所具有的实效。探讨了公证机构转制的现实困境和原因,认为这种困境不是赋予公证处独立法人地位制度所造成的,而是因为公证处法人制度落实不到位造成的。独立法人地位的获得,无论是契合服务性政府建设,或是对当事人合法利益维护,还是对公证事业本身发展都有着重要意义。解决办法应当是进一步保障和完善独立法人制度。As is reflected in practice,notary organizations' status as independent legal entities failed to play its role to the full.Some notary offices are too commercialized to guarantee the quality of their notary acts because of loose control of the supervising department,while others are too strictly restricted by the supervising department.Both cases prevent further development of notary offices.In this paper,the author studies the problems in and causes of the structural reform of notary organizations and concludes that the problems are not caused by notary organizations' status as independent legal entities.Instead they are caused by inadequate realization of notary organizations' status as independent legal entities.Therefore,the author suggests that notary organizations' status as independent legal entities should be further enforced so as to contribute to healthy development of notary business and to better protect legal rights of principals in notary activities.
