试述影响我国司法正义的障碍及构想

摘　　要：正义是人类社会的普遍追求,正义是法律价值中的重要内容,正义只有通过法律才能实现。司法正义是保障法律正义得以实现的手段、方式和途径。我国随着法治建设的不断发展,开始关注司法正义。文章结合我国司法实践,分析目前存在的影响司法正义充分实现的障碍;提出具体的建议和构想,期待我国司法正义的早日实现,为我国积极构建社会主义和谐社会的目标而努力。Justice is the universal pursuit in the mankind society. Justice is the important content of the legal value. Justice is accomplished only with law. Judicial justice is the method, manner and way to guarantee that judicial justice could be achieved. We started to pay close attention to judicial justice with the development of the construction of being ruled by law in China. The author analyses the obstacles af- fecting the realization of judicial justice at present, combining the judicial practice in our country. The concrete suggestion and construction are put forward. We await that judicial justice could be realized soon in China. Positive efforts are made for the target that we build our country into a socialism harmonious society.
