摘　　要：现代社会中,对公民基本权利的侵害不仅来自公权力行为,还有私法行为。因此,宪法基本权利条款能否发生私法上的效力,以保障公民基本权利的问题成为近年来学术界关注的一个焦点。文章试图对基本权利的私法效力问题所涉及的逻辑前提、规范依据、现实土壤等方面进行分析,以期能够找到问题的初步解决方案。In modern society,not only public power but also private behaviour can harm the fundamental rights of citizens.Therefore,whether the fundamental rights items of the Constitution can go into effect to ensure the citizens＇ basic rights becomes a focus of academic interest in recent years.The attemption of this thesis is to analyze the logical premise,base on norms,the real soil about the effectiveness of basic constitutional rights in private law with a view to finding the initial solution.
