摘　　要：工会代表权是一项抽象概括性权利,它可涵盖工会取得的各项实体性权利。工会代表权的界定、行使与保护,直接决定着工会能否以完全独立的法律主体身份实现工会各项权能,能否真正代表与维护职工合法权益。因此,应悉心修订现有法律法规对工会代表权规定之缺陷,以促其逐渐趋于完善。The representative rights of the trade union are abstractive summary rights which contain all kinds of rights of entity.The definition,implementation,and safeguarding of representative rights in the trade union decide whether the trade union can achieve its function directly in totally independent legal entity to represent and protect for the staff＇s legal rights.Therefore,we should adapt the law to accommodate to the staff＇s needs and perfect it further.
