重大环境污染事故罪的罪名分解——江苏盐城水污染案判决的启示

摘　　要：我国刑法第338条采用混合立法模式规定了重大环境污染事故罪,这既不合理,也不利于法律的实施,与罪刑法定原则也不甚相符,应采用国外普遍的单列式立法模式,根据犯罪对象和主观罪过的不同,将重大环境污染事故罪罪名分解为故意污染土地罪、过失污染土地罪、故意污染水体罪、过失污染水体罪和故意污染大气罪、过失污染大气罪等,并增设环境犯罪的危险犯和设置不同的法定刑。Article 338 of the Criminal Law Legislation provides for a mixed major environmental pollution accident offense,which is neither reasonable nor beneficial to law enforcement,and not very consistent with the principle of legality.A commonly-used separate type of foreign legislative model should be adopted.And according to crime the different objects and subjective guilt,the crime of serious environmental pollution accident should be divided into intentional crime of polluted land,contaminated land negligent crime,deliberate contamination of water crime,negligence and intentional contamination of water pollution,atmospheric crime crimes,negligence,atmospheric pollution,crime,and the addition of dangerous and different legal punishment should be established.
