摘　　要：全球化给人类生活带来巨大变化的同时,也给国际社会带来诸多全球性问题。这些全球性问题的解决需要全球性的法律。当前,国际社会以主权国家为思考单位,以国际主义理念为基础的国际法律制度一方面并非真正意义上的全球性法律;另一方面,也无法有效地解决这些全球性问题,因而不能作为全球性法律的基础理念。The globalization not only change the our life style,but also bring us many globalism problems,which need globalism law.The international society is accustomed to solving these problems from the perspective of internationalism.But the international law based on the internationalism neither is genuine globalism law,nor can solve globalism problems effectively.So,it cannot be the basic idea of globalism law.The cosmopolitism surpassed the internationalism,and believe that the human should be cared for ultimately.It can be the basic idea of globalism law for it is the general and universal idea.But,the cosmopolitism is only a part of multiple ideas of the word and can only be applied in special areas.
