摘　　要：在中国法制史研究领域,个案分析法近来多有采用。其中,对晚清名案杨乃武与小白菜案的学术研究备受关注。关于该案的研究,学界取得了丰硕的成果,然而,这些研究成果普遍存在着缺乏应有的学术史回顾、重复劳动、自说自话、注释不规范等令人遗憾和忧思的现象。学界只有消除这些不良现象,才能真正推进学术进步。In the field of Chinese legal history,the method of case analysis has been adopted in many aspects recently.The academic research of the famous case of Yang Naiwu and Xiao Baicai has attracted the attention of scholars.With regards to this case,the academia have obtained fruitful achivements.However,there exist many worrying phenomena in these researches;for example,some researches lack the history review,do the duplicated work.In a addition,the commentary is irregular.Only when the academia eliminate these undesirable phenomena,can it reslly promote the academic progress.
