摘 要:我国房地产融资存在体系不完善、对银行信贷依存度高、宏观调控政策传导不畅、信息不对称等问题,这在一定程度上是政府管制目标不当定位、法律制度滞后所造成的。作者认为,防范房地产融资风险应当厘清政府行为界限、完善资本市场化相关的法律制度、制定和完善房地产二级市场相关的法律法规、建立房地产融资监管方面的法律制度。The property development financing in China is inflicted with such problems as the lack of a comprehensive financing system,high-degree reliance on banks as the financing source,inefficient operation of macro adjustment and control policies and information asymmetry,which result in part from inappropriate control targets of the part of government and the lag of law.The risk prevention of property financing requires clearly defining the extent of government actions,improving the legal system concerning capital market,enacting and improving laws and regulations concerning secondary property market and establishing the legal system of property financing supervision.
