云南强制隔离戒毒场所资源整合研究

摘　　要：强制隔离戒毒制度的构建是我省目前戒毒制度的建设重点,目前,我省强制隔离戒毒制度构建中存在的主要困境是强制隔离执行场所的效果。由于历史原因形成强制隔离戒毒场所面临选择公安强制戒毒场所和司法劳教场所的现状,二选一、二合一或者选择维持现状都是两难选择。我们的研究结论是:云南省强制隔离戒毒执行权应由公安机关统一适用更具合理性。这种安排既符合现代行政法制原则,更适应我省禁吸戒毒现实斗争需要,也为强制隔离戒毒资源整合的全国性难题提供比较研究样本。The construction of compulsory quarantine treatment system is the current development priority in our province＇s rehabilitation system.The major difficulty in present construction is the implementation effectiveness of the compulsory rehabilitation centers.Due to the dilemma choice between police compulsory rehabilitation centers and judicial labor camp,it is always a problem for compulsory rehabilitation center to apply either or both,or keep the status quo.Our conclusion is： it is more reasonable that the implementation right of compulsory rehabilitation in Yunnan Province be given to the public security authorities.Such arrangement is not only consistent with the modern administrative law principles,but also meet the needs for the struggle against the drug use reality in our province,and provides a comparative research sample for the resource integration of compulsory rehabilitation as well.
