作为地方政治过程的美国区划及其技术体系——兼论新时期控制性详细规划的编制创新

摘　　要：作为美国地方政府合法控制土地物权、保护公众利益的规划管理工具,区划条例将一套开发管理技术很好地嵌入了地方政治过程。针对不同的地区特征和政治环境,区划条例通过若干新型区划技术的综合使用,形成了"百纳布"式的土地利用控制体系。通过对美国区划体系的研究发现,区划体系与控制性详细规划两者在运作和技术上有着显著的体系性差异,主要表现为因运作性质和土地制度的不同所导致的差异,基于此,提出新时期控制性详细规划的编制创新方向性建议。Zoning regulations in America are an imbedded part of the local political process for controlling property rights and public interests. Within differing regional and political environments, zoning regulations, and new technologies for their management, have become a comprehensive land use control tool. Research into zoning regulation systems show that they are very different from the Chinese regulatory planning system, which is a product of governance and institutional differences. This paper suggests innovations for regulatory plan compilation in the new era.
