摘　　要：立法理念是立法者创制法律时对法的本质、原则及其运作规律的理性认识,它是一部法律的灵魂,是立法过程中必须建构的观念基础。本文从法理层面对现行《中华人民共和国药品管理法》的立法理念进行分析,阐释对其修订的必要性,并提出修改建议。The creation of any laws necessarily subjects to a certain,directly determines the value of laws and their role in practice, The idea of legislation is the rational knowledge of lawmakers on the nature of law,principles and operation of the law,it is the soul of a law,it must be based on the concept of constructivism during the legislative process.This paper analyzes the idea of legislation in＂Drug Administration Law of People＇s Republic of China ＂,puts forward the need of their amendments and proposes suggestions.
