精神病人盗窃行为特征与责任能力相关性分析

摘　　要：目的探讨精神病人盗窃行为特征与责任能力评定中相关性。方法采用自行设计"盗窃案件司法精神病鉴定资料调查表"对2008年1月至2009年12月份本院司法鉴定的盗窃案件资料72例进行调查。结果72例盗窃案中,无精神病盗窃13例(18.16%),均评定为完全责任能力;各种精神障碍盗窃59例(81.94%),其中责任能力评定为完全责任能力31例(52.54%)、部分责任能力17例(28.81%)、无责任能力11例(18.65%)。作案行为特征中以作案时间、地点、对象、工具、动机、计划性、罪错认识、行为隐蔽性、潜逃、自我保护与责任能力评定结果呈明显相关(r分别=0.54、-0.54、-0.53、0.51、-0.57、0.56、0.60、0.67、0.50、0.69,P均<0.05)。结论对盗窃案件行为特征的分析,评判当时辨认能力和控制能力的损害程度,可作为法学要件辨认能力和控制能力评定的参考依据。Objective To explore the correlation between characteristic of theft behavior and responsibility in patients with psychosis disease.Methods Using self-designed sheet to survey 72 cases of theft.Results Of the 72 cases,13 cases（18.16%） were without psychosis disease and classified as complete responsibility;59 cases（81.94%） had various mental disorders,among which 31 cases（52.54%） had complete responsibility,17 patients（28.81%） had partly responsibility and 11 cases（18.65%） had no responsible capacity.Commit crimes time,place,object,tools,motivation,planning,wrong understanding of crime,acts of concealment,flight,and self-protection ability showed significant correlation with responsibility assessing results（r=0.54,-0.54,-0.53,0.51,-0.57,0.56,0.60,0.67,0.50,0.69,P 0.05）.Conclusions Analysis of the theft behavior characteristics could be a reference in assessing the cognitive and control ability.
