我国见义勇为立法问题探析——以美国法的比较和借鉴为基础

摘　　要：2009年10月发生的轰动全国的长江大学生舍身救人事件,令立法者对突破特殊关系实施救助的必要性进行深思。比较中美两国对"好撒马利亚人"立法的历史、发展及现状,可以看到我国对见义勇为进行立法保护和救济的迫切性。尤其在赋予见义勇为者有限的豁免权及加强对见义勇为者的权益保护及如何救济方面,我国需要进行明确立法,避免"英雄流血又流泪"事件的发生。In October 2009 occurred in the Yangtze River a sensational event that college students save the drowned, which calls for the necessity of legislator to implement relief by breaking through special surroundings. Via comparing on the ＂Good Samaritan＂ legislative history development and current situation between China and USA, we can see the urgency of protection and relief for the heroes. It＇s the time for China to legislate clearly for the heroes to courage and enhance the protection of the fights of courageous persons, avoiding heroes ＂bloodshed but still tears＂.
