试论未成年子女最佳利益原则——以离婚家庭未成年人监护制度为视角

摘　　要：本文首先通过系列客观的事实论据证明离婚对未成年人将会造成极大的负面影响,再由离婚自由权与未成年人成长权的价值对比证明两种价值不能绝对以其中一种为首,只有通过建立合理的程序和制度才可以最大限度的同时保障两种价值。笔者以离婚家庭未成年人监护制度为切入点,在比较各国保护未成年子女利益的司法实践的基础上,着重评析中国法关于之一制度的缺陷,并提出了完善的建议。The author makes efforts to prove the great negative impact on the child caused by divorce through a series of objective fact and investigation.As the value of freedom of divorce and the value of protecting the child are both important,neither of which can be the leading value,the only way to security and maximize the two values is to establish the reasonable procedures and systems.The research focus on the perspective of parents＇custody to the child in the divorced family,and analysis the system deficiencies of Chinese law on the basis of comparing the justice practice in foreign countries with proposing a amendment recommendation.
