春秋时期的战争法——基于《左传》的案例研究

摘　　要：基于《左传》记载的春秋时期的战争史,以案例讨论的方法,重点介绍和讨论了春秋时代战争中若干重要的战争中体现的战争法规则,包括战争权利规则、战争行为规则和战争责任规则。春秋时代战争法洋溢着传统和变革的思想,是中国乃至世界战争法历史的宝贵财富。Based on the ＂Chun qiu＂ history of war recorded by Zuo Zhuan,through a case method,this article introduce and discussed a general classification for rules of war in ancient China,especially in the ＂Chun qiu＂ era,by some of interesting warfare in that period.The classification embodied to three：the rules about right of war,the rules about conduct of war and the rules of war responsibility.The laws of war in ＂Chun qiu＂ era fulfilled with tradition and the idea of change.It is a valuable asset about war history and law history of China and the whole world.
