摘　　要：面对国家日益明显的保护倾向,地方政府的行政不作为、与资本合谋行为也有了一定的转变。在我国的国家与社会关系中,国家处于相对强势的地位,地方政府的行为转变必然会对企业行为产生重要的影响,连同其他影响因素一起导致了雇佣者对农民工权益的侵犯,经历了一个由赤裸裸向采取更为隐蔽的手段转换的过程,在这个过程中,农民工维权能力的不足,使雇佣者获得了很大的行动余地。因此,从根本上说,农民工权益的维护需要这一群体具有维护自身权利主动权的能力。The local government has made some changes in administration,omission and cahoots action with employers,coming with the central government＇s more and more obvious protection tendency for migrant workers.Corporations are inevitably affected during such changes because the government is in a higher status in our society.Together with other factors their infringement of migrant workers＇ rights and interests has changed from straight forward to more secluded.In this process,the immigrants do not have the power to assert their needs so as to leave the employers＇ action a great margin of freedom.So,basically,the immigrant works have to have the capacity to protect their rights by themselves.
