构建油气管道安全保护的长效机制——《中华人民共和国石油天然气管道保护法》述评

摘　　要：2010年6月25日,第十一届全国人民代表大会常务委员会第十五次会议通过《中华人民共和国石油天然气管道保护法》,并自2010年10月1日起施行。该法提供了构建油气管道安全保护长效机制的法律基础。该法围绕油气管道规划、建设、运行、与其他工程相遇关系的处理、安全保护等所产生的法律关系,构建了新的管道保护体系。根据这一体系,政府及有关部门履行管道保护的行政管理职能,管道企业承担管道保护的主要责任,单位和个人履行管道保护的义务;管道工程与其他工程建设相遇时双方相互协商,相互提供便利。此外,管道规划的提出为从源头上加强管道保护提供了保障。《石油天然气管道保护法》还注重管道企业、单位和个人合法权益的保护,贯彻节约用地、保护环境等原则。《石油天然气管道保护法》是我国石油天然气法律体系的重要组成部分,也是石油天然气法立法工作启动以来取得的一项重要法律成果。On June 25th, 2010, the Oil and Natural Gas Pipelines Protection Act was approved at the Fifteenth Meeting of the Eleventh National People's Congress Standing Committee. This law takes effect on October 1st, 2010. Pipelines are a primary natural gas transportation medium in China. Pipeline security is an integral part of energy security and public safety. With the rapid construction of pipelines and urban and rural developments, pipeline security risks have increased and accidents have occurred more frequently. The old pipeline protection system was flawed; soanew, long-term mechanism for pipeline security was urgently needed. The Oil and Natural Gas Pipelines Protection Act establishes legal rights and obligations in pipeline planning, construction, and operation, in conflicts between pipeline and other projects, and in pipeline security. In this new system relevant government departments carry out the administrative functions of pipeline protection; pipeline companies bear direct responsibility for pipeline protection, performed by security units and individuals; when pipeline and other projects conflict, mutual consultation and facilitation is provided for. In addition security is guaranteed at the outset in pipeline planning. The Oil and Gas Pipelines Protection Act also recognizes the legitimate rights and interests of pipeline companies, units and individuals and implements a series of basic principles, such as efficient land use and environmental protection. The Oil and Gas Pipelines Protection Act is an important part of China's developing oil and gas legal system.
