摘　　要：本文试图从刑罚的目的入手,厘清刑罚确定性、及时性、严厉性三者的内在关系和相互地位,探讨刑罚的威慑力的来源和刑罚宽和力的必要性。本文中提出了刑罚的两个直接目的:事后的双面预防和事中的减少控制侵害。并由此引出刑罚的两种力:刑罚的威慑力和刑罚的宽和力。从内部体现刑罚宽严相济的理念,本文重点讨论刑罚目的和刑罚确定性、及时性和严厉性的关系,以及刑罚确定性与严厉性的关系,认为刑罚确定性为刑罚威慑力根本来源,并从对刑罚严厉性的解析来讨论刑罚宽和力的重要性。Starting from the aims of penalty,this article attempts to clarify the internal relations between definiteness,timeliness and severity of penalty and their positions,and explore the origin of deterrent force of penalty as well as the necessity of mercifulness of penalty.The aricle points out that penalty has two aims： bilateral prevention after the event and reduction or control of infringement in the event.On this basis,the writer induces two forces： deterrent force and mercifulness.This paper focuses its discussion on the relationships between definiteness,timeliness and severity of penalty.The writer concludes that the deterrent force of penalty originates from definiteness.Additionally,the writer explores the importance of mercifulness of penalty from the perspective of severity.
