对我国体育法律与道德关系研究的思考

摘　　要：对体育法律与道德关系研究现状进行了分析,体育道德与法律的关系看似简单、熟悉,实则缺乏对它们的深入研究。在研读大量道德与法律关系文献的基础上,运用一般理论对体育道德与法律的关系进行了梳理。确认了交叉律是研究体育道德与法律的进路,在此前提下,沿着两者的联系、两者的相离以及冲突这条主线进行了探索。从研究看,鉴于体育道德与法律的特殊性,它们之间的共性要更多一些,为此,为了更好地保障体育事业发展,应该"德法并举",共同治理,实现体育道德与法治建设的动态平衡。It made an analysis of the present situation of relation between sport law and morality.On the basis of reading many documents of law and morality,using their theory,this thesis combed out the relation between sport law and morality.Confirming the intersecting pattern as the access road to research relation between sport law and morality,at this premise,this thesis probed into their relation,separation and conflict.In the light of their particularity,there are much more commonality between sport law and morality.In order to guarantee the development of sport cause,we should adopt the rule by law and morality meantime,realizing the balance of construction of sport law and morality.
