摘 要:同一海产上有数个担保物权时,各类型权利间关系如何,各国立法规定不一,我国海商法对此亦有明文规定,但条款的简单化处理,使其合理性与当事人利益保护的立法主旨不符。针对现行《海商法》不承认船舶优先权物上代位性这一特性,文章以船舶赔偿金为视角,运用立法论的基本观点,剖析《海商法》关于船舶优先权规定存在的问题,并提出完善这一制度的基本构想。On the occasion that several security interests exist in one maritime property,with the arrangement of the relationship among them,different countries have different legislations. China’s Maritime Law also prescribes it. As the clauses are not comprehensively formulated,they cannot very well reflect the legislative intent and protect the parties’interests. With reference to the absence of the maritime law’s substitution of the maritime lien,the problems existing in the system of maritime lien are analysed by legislative methods for ship damages compensation. A preliminary design for the improvement of the legal system is presented.
