摘　　要：政府采购具有经济调节功能,但政府采购的经济调节功能不能自发实现,采购人和地方政府政府采购主管机关都不会自觉按照经济调节的要求去实施采购和采购监管。《政府采购法》第9条只是提倡性规范,不能对采购人和政府采购主管机关形成有效的激励和约束。要充分发挥政府采购的经济调节功能,必须建立保障《政府采购法》第9条实施的配套法律制度体系。The government procurement has the function of regulating the economy,but the function cannot be achieved spontaneously,the purchaser and the local authority who is in charge of government procurement will not purchase and supervise the procurement consciously with the requirement of regulating economy. Government Procurement Law Article 9 is just an advocated provision,so that it cannot form an effective motivation and restraint on the purchaser and the authority.To bring the function of regulating the economy into full play,the matching legal system which guarantees the implementation of Government Procurement Law Article 9 must be established.
