论我国现行城市房屋拆迁制度存在的问题及完善途径

摘　　要：城市房屋拆迁在实际执行过程中引发了许多社会矛盾,成为当前备受社会各界关注的热点问题。现行城市房屋拆迁存在拆迁安置补偿不合理、公益拆迁与非公益拆迁难以区分、政府自身职责不分,拆迁程序不够健全等问题。对此,必须尽快完善拆迁补偿制度、区分公益拆迁与商业拆迁、明确政府在拆迁补偿中扮演的角色,以进一步改革和完善我国城市房屋拆迁制度。The removal of urban houses triggered a great deal of social problems and attracted the attention of various circles of society.The details of urban houses removal problems are the unreasonable compensation of demolition,the distinction of commonweal demolition and non-public demolition ,the absence of governance, and the maladjustment of demolition procedure. In order to settle these problems, the removal compensation system must be consummated, the public and non-public purpose of demolition must be well distinguished, and the role that government plays in the compensation of demolition must be specified. Consequently, the whole urban house removal system would be reformed and improved.
