《比利时国际私法典》例外条款立法评析及其启示

摘　　要：《比利时国际私法典》不仅将例外条款规定为一般性条款,同时在具体领域中也会适用例外条款。为了避免例外条款的滥用,对例外条款的适用进行了限制,很好地平衡了法律的确定性与灵活性之间的关系。《比利时国际私法典》关于例外条款的规定对我国的国际私法立法有一定的借鉴意义。Exception Clause is not only stipulated as general clause but also applied in specific realm in Belgium Private International Law Code.In order to avoid the clause to be abused,the Code stipulates some restrictions on how to apply the clause,which well balances the relationship between certainties and flexibilities of law.Legislation of exception clause of Belgium Private International Law Code has some enlightenment to Chinese legislation of Private International Law.
