摘 要:西方发达国家在不同时期分别实行压制型和规范型的劳动刑法,而发展中国家则大都对劳动刑法的发展持一种放任态度,存在着严重的规范缺位问题。在推行劳动法治的过程中,刑法以压制或放任姿态介入劳资纠纷均不理性,不仅违背了法治国家原则,而且不利于劳资关系和谐发展。因此,中国应在借鉴先发国家劳动刑法的基础上,合理定位刑法介入劳资纠纷的基本样态。这是中国劳动刑法出场之时的应有理性。The western developed countries had carried out suppression and standard type of labor criminal law at different times,but the developing countries mostly hold an indulgence attitude in the development of labor criminal law,there are serious ab-sence problems in regulation.In the process of labor rule of law,the suppression and indulgence of criminal law is not rational when it get involved in labor disputesi,t not only against the principle of a country under the rule of law,but also have no use to the harmonious development between employers and laborer.Therefore,China should determine the basic forms that criminal law how to get involved in the relations between employers and laborer on the basisi of taking example by the labor criminal law of starter.This is the rationality when China's labor criminal law appear.
