摘　　要：随着国家对残疾人权益保障的日益重视,我国残疾儿童的法律援助工作已取得了一定的成绩,残疾儿童法律援助制度也初步建立,残疾儿童法律援助制度均衡国家与社会利益冲突的价值功能也为人所重视。但是,立法的缺位和制度设计上的漏洞导致了残疾儿童法律援助今日的窘境。进一步完善立法与制度设计,将是我国残疾儿童法律援助制度摆脱困境的必由之路。Along with the country’s increasing emphasis on protection of rights of disabled persons,legal aid for disabled children in China has made great achievements.The legal aid system for disabled children has been initially established,the value function of disabled children legal aid system,which balances the interests of national interests and social in-terests,has been attached importance to.However,the absence of legislation and flaws in system design,led to legal aid for disabled children in today’s predicament.To further improve the legislation and system design,will be our sys-tem of legal aid for disabled children the only way to get through existing difficult situations.
