摘 要:改革开放以来,政策主要被看成法律实践的阻碍因素和影响法学"学科自主"的消极因素,这样的认识促成了制定法意义上的中国主流法治话语的形成。另一方面,在完成了对政策的批判任务后,中国的法理学试图将政策驱逐出其研究领域,"制定法"、"习惯"、"判例"成为中国法理学的研究重心,此即法理学研究中的"去政策化"。法理学研究的"去政策化"会带来诸多消极后果,法理学研究必须与制定法意义上的主流法治话语保持距离,惟此,法理学才能得到真正发展,而消除法理学研究"去政策化"的基本前提在于恢复"政策"的学术概念身份。Since the reform and opening upon the one hand,policy was seen as the main obstacles to legal practice and impact of law "subject autonomy" of the negative factors,such recognition has led to the development of mainstream discourse on rule of law which is in statutory law sense.On the other hand,the completion of critical tasks of policy,China's jurisprudence attempts to expel their field of study,"statutory law","habit","case" became the focus of the study of jurisprudence,namely," de policy" in jurisprudence study. "De-policy" will bring about many negative consequences to the study of jurisprudence,so China's jurisprudence research should kept a distance from the mainstream discourse on rule of law which is in statutory law sense.It is the only way to get the actually development of jurisprudence.The basic premise of the elimination of jurisprudence research "de-policy" is to restore "policy" the concept of academic identity.
