摘　　要："订单式"人才培养模式是以就业为导向的教育模式。该教育模式由学校、企业和学生形成了三对法律关系,从教育的角度看学校与学生的关系既属行政法律关系又属民事法律关系,从合作的角度看学校与用人单位属民事法律关系,企业与学生的法律关系是教育合同关系。Training to persons with the order-model pattern focus on the employment.The education pattern is formed by schools,the enterprises and students,form three pairs of legal.The legal relationship between schools and students is not only the administration legal relationship,but also the civil legal relationship.Schools and enterprises which based on the agreement form the civil law relation.Between enterprises and student still exists the legal civil contract.
