效率与效率分析——关于《法律的经济分析》核心思想的透析

摘　　要：波斯纳的《法律的经济分析》代表着法律经济学的最高成就。其核心思想——法律的效率分析,准确把握了"效率"与"效率分析"在法律经济学中的地位,是对传统的法律分析方法和法律价值理念的革新,但对于"效率"与其他法律价值发生冲突时如何取舍的问题,该书没有提出明确的解答。该文在剖析其核心思想的同时,提出引入"均衡理论"解决法律价值冲突的设想。Richard A Posner＇s ＂Economic Analysis of Law＂ represents the highest achievements of Law economics.Its core idea ——the efficiency analysis of the law,accurately grasps the status of ＂efficiency＂ and ＂efficiency analysis＂ in law economics,is an innovation for traditional legal analysis method and legal values idea.The book has not proposed explicit explanation to the problem on how to choose between the conflict problem of ＂efficiency＂ and other law values.While this article analyzes the core idea of the subject,it proposes the introduction to the ＂equilibrium theory＂ idea to resolve legal values conflicts.
