生产、销售伪劣产品罪罪名探讨

摘　　要：刑法第140条罪名为"生产、销售伪劣产品罪",但学者间对本罪罪名到底应当表述为何者科学见仁见智、莫衷一是,主要有"生产、销售一般商品罪"、"生产、销售伪劣商品罪"、"生产、销售一般伪劣商品罪"、"生产、销售普通伪劣商品罪"和"销售伪劣产品罪"等五种不同观点。这五种观点都存有缺陷,将"生产、销售伪劣产品罪"罪名分解为"生产伪劣产品罪"和"销售伪劣产品罪"更为科学,可以严厉打击生产和销售伪劣产品犯罪行为。The article 140 in the Criminal Law is definitized as ＂Crime of Producing and Selling Fake and Substandard Products＂ by the supreme judicial departments.However,scholars have diverse standpoints on the accusation.There are five different views such as ＂Crime of Producing and Selling Normal Commodities＂,＂Crime of Producing and Selling Fake and Substandard Commodities＂,＂Crime of Producing and Selling Normal Fake and Substandard Commodities＂,＂Crime of Producing and Selling General Fake and Substandard Commodities＂ and ＂Crime of Selling Fake and Substandard Products＂.All of these have drawbacks,we think it more scientific to name it ＂Crime of Producing Fake and Substandard Products＂ and ＂Crime of Selling Fake and Substandard Products＂.By doing this we can crack down on the crimes severely.
