死亡赔偿制度的分层构建——基于法经济学视角

摘　　要：死亡赔偿制度可借助补偿性赔偿和惩罚性赔偿进行分层构建,从而实现填补损害和预防侵权的双重功能。补偿性赔偿宜采固有损害主义,并基于福利水平维持说评估赔偿额的大小。在故意逃逸以逃避责任和故意侵权致人死亡案件中,应该适用惩罚性赔偿,以产生威慑和预防效应,惩罚性赔偿数额的确定要根据逃逸概率、收入水平和侵权人财富等来加以确定。The stratified construction of death compensation system can make use of compensatory damages and punitive damages to fill the damage and prevent the infringement. Innate injury system should be applied to compensatory demages and the amount of compensatory damages can be evaluated based on the theory of welfare standards. In the case of deliberate escape from responsibility and causing death by intentional right violations, punitive compensation should be applied to deter and prevent violations. The amount of punitive compensation is to be determined by the probability of escape, income levels and wealth of infringer, etc.
