摘 要:我国地方立法立项主要指省级行政区和较大的市人大的立法规划与年度立法计划编制活动,其产品具有非竞争性、不可分割性和非排他性的特点。我国虽然采用计划为主的立法模式,但是也应遵循立法消费市场规律,最终实现立法立项供给环节的最优化资源配置。为此,地方人大必须树立立项效益意识,及时回应社会公众多元化的立法需求,并借助国家财政供给体制的改革和立法立项程序完善,不断提升自身立法供给能力和水平,实行科学立项、民主立项和法治立项。To establish local legislation projects means the preparation for legislation program and the annual legislation planning of People's Congress of provincial administrative and larger cities in China. As a type of public goods, it has non-competitive, indivisibility and exclusive traits. Our nation uses plan-based legislation model, nevertheless, local legislative bodies should follow the legislative consumer market rules in order to achieve the most optimal allocation of legislative items resources. Therefore, all levels of Local People's Congress should have the awareness of scientifically legislative projects effectiveness, respond timely to the diverse legisla- tive demands of the public, and improve continuously the legislative supply ability and level by means of the reform of national finance supply system and the perfection of legislative and project procedure to finally set up democratic, scientific and legal legislation projects in China.
