美国金融改革法案场外衍生产品法律监管改革的启示

摘　　要：本文通过分析危机前美国对场外金融衍生产品交易由于监管缺失、监管漏洞以及信息不透明等方面的监管缺陷导致场外衍生产品交易对危机的蔓延起到了推波助澜的作用,进而也成为美国金融监管法案改革的重点,并进一步分析美国金融监管法案就场外衍生产品交易的监管体现出监管主体更加明确、风险监管实现系统性风险和稳定性风险监管的并存、监管方式由行业自律转为行业自律与政府监管并存等的特点。最后就我国金融衍生产品的监管框架、增强交易的透明度、确定中央交易对手清算和交易中心交易以及加强国际协调等方面提出建议。The article analyzes the supervision deficiency and gaps to the over-the-counter derivatives which brought out the financial crisis so that it becomes the key point of financial supervision reform of America,and makes the further analysis on the characteristics of the over-the-counter derivatives supervision of America.Finally,the article makes suggestions on our supervision frame to the over-the-counter derivatives,proposes to strengthen the transparency of the market,identify the central liquidation and exchange trading and enforce the international coordination.
